TERMS OF SERVICE INTRODUCTION

L.L.C and its affiliates (collectively “GMNSM”, “we” or “us”).

These Terms apply to all users of the Services, including without limitation users who are participants, trainees, athletes, coaches, vendors, and/or contributors of content. We reserve the right to limit or prohibit applications that, in our sole judgment, appear to be placed by dealers, resellers, or distributors of training services.

3. SERVICES

5.2. The training program, along with all related materials, is our exclusive intellectual property. 5.3. The training program and other materials provided on the Website are licensed, not sold, to you. You agree that we and our licensors own all rights, titles, and interests in the training program and content, including all intellectual property rights in them, and that we retain ownership of all copies of the materials even after they have been used on your device.
5.4. Except as expressly specified in these Terms, you may not:
5.4.1. copy, modify, or create derivative works of the training program or materials, including adaptations or modifications for commercial purposes;
5.4.2. sell, rent, lease, distribute, transfer, sublicense, or otherwise assign any rights to the training program to any third party;
5.4.3. make the training program available to multiple users by uploading the materials to a file-sharing service or any network that allows simultaneous use on multiple devices.
5.5. We are not obliged to maintain or update the training program or provide you with updates, upgrades, or related services. We may, at our sole discretion, release updates or changes to the program, suspend access to it for any period of time or permanently, and automatically update or upgrade the version of the program on your device.
5.6. The license for using the training program granted under these Terms remains in effect until terminated by you or us. You may terminate the license at any time by deleting all copies of the program from your devices. If you breach any of these Terms, the license will automatically terminate without notice, and you must cease all use of the program and delete all copies of it.
5.7. GMNSM reserves the right, at its sole discretion, to change, modify, add, or remove this license at any time for any reason.
5.8. These Terms grant only the right to use the training program and content while these Terms and the specified licenses are in effect and do not transfer any ownership rights to these materials. All rights, titles, and interests in the training program and content remain our sole property.

GMNSM does not provide any warranties or guarantees concerning the prevention of injuries and assumes no liability for any injuries that occur during the use of the Services.
10. TERM, AMENDMENT AND TERMINATION
10.1. The obligations and liabilities of the parties incurred prior to the termination date will survive the termination of this agreement for all purposes.
10.2. From time to time, we may modify or amend the Terms. If we do so, we will post such modifications or changes in the Services. It is your responsibility to check this page periodically. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes.
10.3. Notification of the User of the amendments and/or additions made hereto shall be made by posting a notification on the Website or at GMNSM’s discretion, the User may be additionally notified by any other means specified in the present Terms.
10.4. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our Services.
10.5. If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination; and/or we may deny you access to our Services (or any part thereof).
11. GOVERNING LAW AND DISPUTE RESOLUTION
11.1. The Services provided to you shall be governed by the laws of the UAE without regard to its conflict of laws principles.

In case of failure to resolve disputes and disagreements through negotiations, the settlement shall be in accordance with the claim procedure. Claims shall be reviewed within 30 calendar days.
12. FORCE MAJEURE
12.1. GMNSM will not be liable to you for any delay or failure in performance under these Terms due to causes beyond the reasonable control of GMNSM, provided that such causes could not have been prevented by reasonable precautions and could not have been circumvented through the use of reasonable alternative sources, workaround plans, or other means. These causes include, but are not limited to, strikes, shortages, failure of suppliers, riots, insurrection, fires, floods, storms, earthquakes, acts of God, war, governmental action, labor conditions, and power outages.
13. COMMUNICATION
13.1. In the event that, under these Terms, GMNSM provides the User with any information related to the Services provided hereunder, such information may be delivered to the User via the Website without being sent directly to the User's address and/or by using other secure means.
13.2. GMNSM shall respond to requests from the User promptly and within 7 calendar days following the date of receipt of the request. The response time may, in some cases, exceed 7 calendar days.
14. MISCELLANEOUS
14.1. Entire Agreement. These Terms and any policies or operating rules posted by us on the Website or in relation to the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).
14.2. Severability. By agreeing to participate in the Services, you acknowledge and agree that GMNSM is not responsible for any injuries that may occur during training sessions. You accept all risks associated with physical activities and acknowledge that you are responsible for ensuring your own safety and well-being. GMNSM does not provide any warranties or guarantees concerning the prevention of injuries and assumes no liability for any injuries that occur during the use of the Services.
10. TERM, AMENDMENT AND TERMINATION
10.1. The obligations and liabilities of the parties incurred prior to the termination date will survive the termination of this agreement for all purposes.
10.2. From time to time, we may modify or amend the Terms. If we do so, we will post such modifications or changes in the Services. It is your responsibility to check this page periodically. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes.
10.3. Notification of the User of the amendments and/or additions made hereto shall be made by posting a notification on the Website or at GMNSM’s discretion, the User may be additionally notified by any other means specified in the present Terms.
10.4. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our Services.
10.5. If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination; and/or we may deny you access to our Services (or any part thereof).
11. GOVERNING LAW AND DISPUTE RESOLUTION
11.1. The Services provided to you shall be governed by the laws of the UAE without regard to its conflict of laws principles.

In case of failure to resolve disputes and disagreements through negotiations, the settlement shall be in accordance with the claim procedure. Claims shall be reviewed within 30 calendar days.
12. FORCE MAJEURE
12.1. GMNSM will not be liable to you for any delay or failure in performance under these Terms due to causes beyond the reasonable control of GMNSM, provided that such causes could not have been prevented by reasonable precautions and could not have been circumvented through the use of reasonable alternative sources, workaround plans, or other means. These causes include, but are not limited to, strikes, shortages, failure of suppliers, riots, insurrection, fires, floods, storms, earthquakes, acts of God, war, governmental action, labor conditions, and power outages.
13. COMMUNICATION
13.1. In the event that, under these Terms, GMNSM provides the User with any information related to the Services provided hereunder, such information may be delivered to the User via the Website without being sent directly to the User's address and/or by using other secure means.
13.2. GMNSM shall respond to requests from the User promptly and within 7 calendar days following the date of receipt of the request. The response time may, in some cases, exceed 7 calendar days.
14. MISCELLANEOUS
14.1. Entire Agreement. These Terms and any policies or operating rules posted by us on the Website or in relation to the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).
14.2. Severability. In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision will nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed severed from these Terms of Service. You acknowledge and agree that GMNSM may assign its rights and obligations under these Terms, including rights and obligations concerning insurance, and, in such context, share or transfer information provided by you while using the Services to a third party.
14.4. No Waiver. The failure of us to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
14.5. Ambiguities. Any ambiguities in the interpretation of these Terms will not be construed against the drafting party.
14.6. Errors, Inaccuracies, and Omissions. Occasionally, there may be information in the Services that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability.
